7.04.030 Golf Carts

Provisions of M.S.A. §§ 84.81 to 84.915, as amended from time to time, shall be applicable to the City. In those cases where there is a conflict between the provisions of M.S.A. §§ 84.81 to 84.915 and this chapter, the more restrictive regulation shall apply.

  1. No person shall operate a snowmobile or all-terrain vehicle on a public sidewalk or upon any public park or playground.
  2. No person shall operate a snowmobile on city streets except for when traveling in the most right-hand lane available for automobile traffic or as close as practicable to the right-hand curb or edge of the roadway and when traveling in the same direction as automobile traffic in that lane.
  3. No person shall operate a snowmobile in the ditch except in the ditch bottom or outside slope of any drainage ditch which lies within and runs parallel to any city controlled public road easement.
  4. No person shall ride a snowmobile in the right of way as a substitute for trail riding. Travel in the right of way shall be used to reach a destination such as a trail, public body of water, public gathering place, residence, etc.
  5. No person shall operate a snowmobile or all-terrain vehicle between the hours of midnight and 7:00 a.m. provided that all-terrain vehicles may be used for snow plowing purposes during prohibited hours.
  6. No person shall operate a snowmobile or all-terrain vehicle within ten (10) feet of a residential dwelling unless such operation occurs on property owned or occupied by the operator of the snowmobile or all-terrain vehicle and such operation is for the purpose of accessing a public right-of-way from private property.

  1. Permit required. No golf cart may be operated on a street, alley, sidewalk, or other public property without first obtaining a permit from the city.
  2. Permit application. Every application for a permit must be made on a form supplied by the city and must contain all of the following information:
    1. The registered owner's name, address, and telephone number;
    2. The make, model, year, and number of the golf cart;
    3. Proof of insurance. The applicant must provide evidence of insurance in compliance with the provisions of Minnesota Statutes concerning insurance coverage for golf carts;
    4. Current driver's license or reason for not having a current license; and
    5. Other information as the city may require.
  3. Permit fee. The permit fee shall be as set forth in the city's fee schedule.
  4. Approval. No permit shall be granted or renewed unless the following conditions are met:
    1. The applicant has not had his or her driver's license revoked as the result of criminal proceedings.
    2. If the application for the permit meets all of the requirements of this section, the permit application shall be approved by the Planning Director or his/her designee and a permit shall be issued by the city.
  5. Appeal. If a permit application is denied for any reason, the denial may be appealed to the city council.
  6. Duration. Permits shall remain valid for a period of three years from the date of issuance.
  7. Golf cart operation requirements. The issuance of a permit and adherence to the criteria set forth below are specific to the city. Within the city, golf cart operators holding permits from the city may only operate the golf cart on city streets designated by this section. The following operation requirements shall apply:
    1. The operator must have his or her actual physical possession a valid, current, and unrevoked golf cart permit while operating the gold cart on a city street along with proof of insurance;
    2. The operator is responsible for operating the gold cart in accordance with this section, and all other city, county, and state laws and regulations;
    3. Golf carts must be operated on the pavement and not within any boulevard or ditch, city sidewalk, trail or walkway used for pedestrian travel, or other publicly owned land;
    4. A golf cart must only transport as many persons as it was designed by the manufacturer to carry;
    5. Golf carts must not be operated on city streets during inclement weather or when visibility is impaired by weather, smoke, fog, or other conditions or at any time when there is insufficient visibility to clearly see persons or vehicles on the roadway at a distance of 500 feet;
    6. Every person operating a golf cart on a city street has the rights and duties applicable to the driver of any other vehicle and must comply with the provisions of any traffic law of the city and Minnesota Statutes Chapter 169, as it may be amended from time to time, except when these provisions cannot reasonably be applied to motorized golf carts and except as otherwise specifically provided in Minnesota Statutes Section 169.045, subdivision 7, as it may be amended from time to time.
  8. Equipment required. All golf carts must have the following equipment when operating on city streets:
    1. A slow-moving vehicle emblem provided in Minnesota Statutes Section 169.522 prominently displayed on the rear of the vehicle;
    2. A rear-view mirror so located as to reflect to the operator a view of the roadway for a distance of at least 200 feet to the rear of the vehicle; and
    3. Parking brakes to hold the vehicle in place when unattended.
    4. Night Driving. Golf cats may only be operated between the hours of sunrise and sunset unless equipped with original headlights, taillights, and rear-facing brake lights.
  9. Designated city streets. Golf carts are only permitted to be operated on designated city streets. Designated streets are those which are considered to be local in nature, under Lake Elmo jurisdiction, and 30 mph or less. Golf carts are not permitted to travel down County, State, or roads built with State-Aid funds. The streets which are designated for golf cart operation are shown on the city's Golf Cart Street Map, which is on file and of record with the Planning Director. Golf Carts are permitted to cross over any non-designated street or highway that intersects a designated city street. With this exception, golf carts shall not, for any period of time or distance, travel down any street or highways not permitted for golf cart use.
  10. Permit revocation. The City Council may suspend or revoke a permit granted hereunder upon a finding that the holder has violated any of the provisions of this section or Minnesota Statutes Chapter 169, as it may be amended from time to time, or if there is evidence that the permit holder cannot safely operate the golf cart on the designated city streets.

7.08.010 Adoption Of Highway Traffic Regulation Acts
7.08.020 Exhibition Driving Prohibited

The regulatory provisions and definitions of M.S.A. ch. 169, Traffic Regulations, and of M.S.A. ch. 168B, Abandoned Motor Vehicles and Towing, are, by this section, adopted as the traffic code and parking regulations for the use of highways, streets, alleys and other portions of the city and are, by this section, incorporated in and made a part of this Code. The parking provisions shall apply to the parking of trailers as well as vehicles.

  1. No person shall turn, accelerate, decelerate, or otherwise operate a motor vehicle within the city in a manner which causes unnecessary engine noise or backfire, squealing tires, skidding, sliding, swaying, throwing of sand or gravel, or in a manner simulating a race.
  2. Unreasonable squalling or screeching sounds emitted by tires, or the unreasonable throwing of sand or gravel by the tires, is prima facie evidence of a violation of this section.

7.12-I GENERAL PROVISIONS

7.12.010 Generally
7.12.020 Temporary Parking Permit
7.12.030 Winter Parking

  1. Parking and fire lanes.
      1. The council, upon report and recommendation of the administrator and fire chief, may order the establishment of fire lanes on public or private property in order that the travel of fire equipment may not be interfered with and that access to fire hydrants or buildings may not be obstructed. The fire lanes shall be designated by appropriate signs indicating "no parking - fire lane" or words of similar import.
      2. The city shall erect and maintain the signs on public property. The owner of private property shall erect and maintain the signs on owner's property at owner's expense within 30 days after notification of the establishment of a fire lane.
    1. After appropriate signs have been erected, no person shall park a vehicle or otherwise occupy or obstruct a fire lane.
  2. Parking term. No person shall park or permit any vehicle to stand upon any highway, street, alley, or any other public property in the city for more than 48 consecutive hours.
  3. Trailers. The provisions of this section shall apply to the parking of trailers as well as vehicles.

  1. An owner who resides adjacent to a posted "No Parking" zone may obtain up to two temporary parking permits per calendar year for a special non-business or social event (including, but not limited to, weddings, birthday parties, family reunions, bar mitzvahs, confirmations, first communions, fraternal gatherings, holiday gatherings, and the like) by making application to the city administrator at least three working days before the date of special event.
  2. A temporary parking permit shall allow for parking of residential passenger vehicles within a "No Parking" zone for a period not to exceed 24 consecutive hours.
  3. The city administrator shall notify the county sheriff before issuing a temporary parking permit and shall arrange to have the posted "No Parking" signs covered during the period described in the permit.

  1. It shall be unlawful for any person to stop, stand or park any vehicle or trailer or permit the same to stand or park on any street or alley within the city between the hours of 2:00 a.m. and 7:00 a.m. from November 1 until March 31 of the following year.
  2. Parking is also restricted at any time that snow accumulation equals or exceeds two inches or more until the street is cleared of snow.
  3. The winter parking ordinance does not apply to private streets (marked with a blue street sign), only to public roadways.
  4. Violation of this section shall constitute a petty misdemeanor and shall be punishable by payment of a fine as set forth in the city's fee schedule.
